Terms and Conditions
Clear terms for a
human space.
A plain-language MVP draft describing how Presence works and what everyone can expect.
The short version
Be 18 or over. Be honest about who you are. Treat the other person with care. Do not record conversations. Presence is peer listening—not therapy, professional advice or a crisis service. Either person may leave at any time.
1. Who provides Presence
These Terms form an agreement between you and [LEGAL NAME OF OPERATOR], established at [REGISTERED OR BUSINESS ADDRESS] (“Presence”, “we”, “us” or “our”). Contact us at here@sitwithsomeone.com. The country in which the operator is legally established—not the founder’s temporary travel location—should be stated here.
2. Eligibility and accounts
Presence is only for adults aged 18 or over. You must provide accurate information, use your own Google account to sign in, and keep access to that account secure. Your public name may differ from your Google name, but you may not impersonate another person or misrepresent your identity, qualifications or experience.
3. What Presence provides
Presence helps one person connect with an available Listener for a private audio or video conversation. Listeners are everyday community members. Availability, matching, connection quality, uninterrupted access and any particular outcome are not guaranteed. The MVP is currently offered without charge; we will give notice before introducing paid features.
4. Not therapy, professional advice or crisis care
Presence is not therapy, healthcare, counselling, diagnosis, treatment, emergency response, crisis intervention, or medical, legal, financial or other professional advice. No professional, fiduciary or clinical relationship is created. If you or someone else may be in immediate danger, contact the appropriate local emergency service. If you need urgent mental-health support, contact a qualified crisis service in your country.
5. Calls, privacy and recording
Presence does not record or transcribe calls. You must not record, photograph, transcribe, publish or share another person’s conversation without a lawful basis and their clear prior consent. Share only what feels safe. Either person may decline video, avoid a topic or end a call at any time without giving a reason.
6. Community conduct
You must follow the Community Guidelines. In particular, you may not harass, threaten, discriminate, exploit, scam, impersonate, solicit money, promote services, pursue sexual or romantic contact, pressure someone to move off-platform, or use another person’s vulnerability against them. Illegal use is prohibited.
7. Listener participation
Listener approval is permission to participate in this community role; it is not a professional credential, employment relationship or guarantee of future access. Listeners control their availability and may decline or end conversations. Presence may review a Listener profile or approval if identity, conduct or safety concerns arise.
8. Feedback, notes and public appreciation
Callers may leave private feedback and, when offered, one-way notes or appreciation. Positive feedback may reach a Listener’s Inbox. Negative feedback and safety concerns may be routed privately for review. Nothing is made public merely because it was submitted; public appreciation requires the caller’s choice and Presence’s review.
9. Safety actions and moderation
You may end a call, block another person or raise a safety concern. We may investigate, preserve relevant records, warn, limit, pause, suspend or remove an account when reasonably necessary to protect people, enforce these Terms or comply with law. Where appropriate, we will explain material restrictions and provide a way to request another review athere@sitwithsomeone.com. Blocking someone is a private choice and does not submit a report. A report alone does not restrict either account; a person reviews it. A report that cannot be confirmed is not treated as deliberately false. Deliberate fabrication or repeated use of reports to harass someone may itself lead to a proportionate account action after review.
10. Third-party services
Presence currently relies on Google for sign-in, Supabase for authentication, database and storage services, and Daily for real-time audio and video. Their services may be subject to their own terms and privacy notices. We are not responsible for outages or changes outside our reasonable control, but we remain responsible for selecting and configuring providers appropriately for Presence.
11. Intellectual property
Presence’s name, visual design, software and original content belong to[LEGAL NAME OF OPERATOR] or its licensors. You retain rights in material you submit. You give Presence a limited licence to host, display and process that material only as needed to operate, protect and improve the service, according to the Privacy Policy and your visibility choices.
12. Account closure
You may stop using Presence, sign out or request account deletion through Settings. We may retain limited information where required for safety, dispute handling or law, as explained in the Privacy Policy. Provisions that naturally survive closure—including ownership, disclaimers and responsibility for past conduct—continue to apply.
13. Disclaimers and liability
Presence is provided on an “as available” basis. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded. The final warranty exclusions, liability cap, consumer-rights wording and any indemnity must be adapted to the operator’s country and launch markets before public release. [JURISDICTION-SPECIFIC LIABILITY CLAUSE]
14. Governing law and disputes
These Terms are governed by the laws of [GOVERNING COUNTRY/STATE], subject to any mandatory rights you have under the law where you live. The courts or agreed dispute process will be [COURTS / DISPUTE PROCESS]. This section requires legal review once the operator and initial launch markets are chosen.
15. Changes to these Terms
We may update these Terms as Presence develops. We will publish the revised date and give reasonable notice of material changes through the service or the contact information linked to your account. Your continued use after the effective date means the updated Terms apply.
